Regolamento escursioni

La Guida Angelo Bellobono è socio effettivo della Lagap (Libera Associazione Guide Ambientali-escursionistiche Professioniste) tessera n° 731.
Le Guide sono assicurate per la “Responsabilità Civile” per quanto dovesse accaderti per loro imperizia, imprudenza o negligenza.
La Guida non è responsabile di quanto avviene durante gli spostamenti con mezzi motorizzati.
La Guida può non accettare partecipanti non abbigliati ed attrezzati come richiesto nell’informativa.
I partecipanti si impegnano ad ottemperare a prima e semplice richiesta alle disposizioni della Guida in materia di escursione e a far adeguare ad esse eventuali minori accompagnati.
I cani, se ammessi, devono essere tenuti secondo le disposizioni di legge in materia di luoghi pubblici e non devono essere iscritti al Registro dei cani morsicatori e con problemi di comportamento.
A suo insindacabile giudizio la Guida potrà in ogni momento, a tutela della sicurezza e del benessere degli accompagnati (anche di un solo accompagnato), modificare in modo anche sostanziale il programma e l’itinerario proposto e/o addirittura annullare l’escursione predisponendo il rientro del gruppo.
I partecipanti e la Guida faranno fotografie o filmati.
Partecipando prendi atto ed acconsenti al fatto che potrebbero postare sui social la tua immagine o fare altri usi non commerciali della stessa. Ti impegni inoltre a mantenere il tuo cellulare in modalità silenziosa e a non arrecare disturbo ai partecipanti e a alla fauna selvatica.
Partecipando, dichiari che hai preso visione dell’impegno fisico richiesto e che non ritieni di avere patologie tali da non poterlo affrontare serenamente.
I dati qui conferiti saranno trattati nel rispetto del Regolamento Europeo sulla Privacy. Copia estesa del regolamento è sempre disponibile nello zaino della Guida e sul sito www.casaappennino.it

REGOLAMENTO ESTESO GUIDE GAE LAGAP
Angelo Bellobono è socio effettivo  (tessera n. 731) della “Libera Associazione Guide Ambientali-escursionistiche professioniste”(LAGAP). Esercitano la professione ai sensi della Legge 4/2013.
Il codice di condotta professionale cui aderiscono è riportato, ai sensi di legge, all’area documenti del sito: www.lagap.org. È regolarmente assicurato per la propria attività, con una polizza che copre la propria Responsabilità Civile; questa polizza non copre gli infortuni dei partecipanti non attribuibili alla sua condotta (causati cioè da loro disattenzione o semplice sfortuna) e incidenti d’auto, danni ai mezzi o infortuni occorsi a seguito di incidente d’auto avvenuto, ad esempio, nella fase di avvicinamento e ritorno in macchina con mezzi propri, come pure durante eventuali spostamenti effettuati nell’ambito dell’uscita.
La polizza RC, inoltre, non copre danni, anche occorsi durante l’escursione, dovuti a comportamenti dolosi dei partecipanti, che rispondono personalmente del proprio comportamento e di quello dei minori da loro accompagnati, o all’inosservanza delle istruzioni della Guida.

La nostra associazione di categoria ha attivato lo Sportello del Cittadino istituito a tutela dell’utente ai sensi dell’Art. 2c. 4 della legge n.4/2013 e dell’art. 27 ter del codice del consumo di cui al d.lgs. N 206/2005, dove potrai rivolgerti per ottenere un giudizio sulla mia condotta professionale. Il Collegio dei Probiviri, il cui regolamento è parimenti indicato nell’area “documenti” del sito: www.lagap.org, ha inoltre autorità di arbitrato e lodo in caso di contenzioso.

Regolamento d’escursione
Il partecipante, nel compilare e sottoscrivere la dichiarazione fornita prima dell’inizio delle attività, accetta il presente regolamento, pubblicato nel sito web www.casaappennino.it , oppure divulgato mediante posta elettronica, social network o mostrato in fase di inizio attività contestualmente al documento di autocertificazione e dichiarazione. Copia del regolamento è sempre presente nello zaino della Guida, per eventuale consultazione.
– Il partecipante/richiedente, dopo aver confermato la sua adesione alle attività, si impegna a rispettare l’orario di appuntamento e/o partenza, consapevole del fatto che il ritardo massimo consentito è di 30 minuti. Dopo tale termine, e a suo insindacabile giudizio, la Guida potrà decretare l’inizio delle attività (e/o dare il via a eventuali spostamenti) senza obblighi di attesa nei confronti del partecipante/richiedente ritardatario.
– La Guida si riserva la facoltà di negare la partecipazione all’iniziativa a chi dovesse presentarsi in condizioni psicofisiche visibilmente non confacenti (a titolo esemplificativo a seguito di assunzione di sostanze stupefacenti o alcool) e a chi mostrasse abbigliamento ed equipaggiamento non idonei e non in linea con quanto indicato in fase di divulgazione dell’iniziativa stessa, senza che tale decisione comprometta l’attività o ponga in essere contestazioni di qualsivoglia natura. Qualora tali circostanze si verificassero ad escursione avvenuta (ad esempio dopo il pranzo in rifugio) faranno decadere qualsiasi responsabilità della Guida verso l’incolumità dell’accompagnato fatto salvo il soccorso sanitario richiesto dal caso.
– Se richiesto, l’accompagnato dovrà equi formarsi in qualsiasi momento – e far equi formare i minori da lui accompagnati – con prontezza e diligenza al comportamento indicato dalla Guida in merito – a titolo puramente esemplificativo – al passo da tenere, alla posizione rispetto al gruppo, alla distanza rispetto agli altri accompagnati ecc…, pena la decadenza di qualsiasi responsabilità della Guida verso l’incolumità dell’accompagnato stesso.
– Durante l’ attività l’accompagnato è tenuto a rispettare tutte le istruzioni fornite dalla Guida e a seguire il percorso stabilito senza allontanarsi o abbandonare il gruppo e senza superare la Guida, salvo in casi di specifica e motivata richiesta da parte di quest’ultima.

Si impegna altresì ad assumere un comportamento conforme ai principi di legalità e rispetto dei principi di civiltà e a non assumere, in nessun caso, comportamenti contrari alla legge e alle norme civili che possano mettere in pericolo la propria o l’altrui incolumità. L’accompagnato è tenuto dunque ad osservare sempre la massima prudenza in modo da non mettere a rischio l’incolumità propria ed altrui, ad avere un comportamento disciplinato, ispirato al rispetto reciproco ed alla buona educazione, a collaborare con la Guida e gli altri componenti della comitiva al fine di assicurare la buona riuscita dell’attività e di garantire a tutti la massima sicurezza e soddisfazione.
– A suo insindacabile giudizio la Guida potrà in ogni momento, a tutela della sicurezza e del benessere degli accompagnati (anche di un solo accompagnato), modificare in modo anche sostanziale il programma (o addirittura indire il rientro) senza che ciò possa in alcun caso dar luogo a contestazioni da parte dei partecipanti, ad esempio, in occasione di maltempo, in caso di infortunio o grave stanchezza o disagio di uno dei partecipanti, e in ogni altro caso di pericolo attuale o presunto. In nessuna circostanza è prevista la restituzione all’accompagnato della somma versata.
– In fase di divulgazione dell’iniziativa la Guida indica i casi in cui l’escursione potrebbe essere rimandata, tra i quali pioggia o neve, o in genere condizioni meteorologiche non idonee: le valutazioni vengono fatte nel giorno che precede l’evento,consultando previsioni aggiornate. Ad uscita confermata, una volta iniziata l’escursione e versata la quota di partecipazione nessun imprevisto di carattere meteorologico, tranne casi espliciti di immediato o presunto pericolo valutati come tali dalla Guida, può interrompere in maniera definitiva l’attività. Qualora tale evenienza dovesse comunque verificarsi, l’interruzione dell’attività non comporta in nessun caso la restituzione all’accompagnato della somma versata.
– A causa di regolamenti degli enti territoriali o di pericoli per gli accompagnati e gli altri escursionisti, o per i cani stessi (incontro con cani da guardiania) i cani non sono ammessi. L’informativa all’escursione riporta sempre la circostanza. I cani, se ammessi, devono essere tenuti secondo le disposizioni di legge in materia di luoghi pubblici e non devono essere iscritti al Registro dei cani morsicatori e con problemi di comportamento; riassuntivamente, devono essere tenuti a guinzaglio non superiore a un metro e mezzo, e il proprietario deve portare con sé museruola ed essere disponibile a farla indossare al cane in caso di spavento degli accompagnati o, comunque, se richiesto dalla Guida.
– Per non arrecare disturbo ai partecipanti e alla fauna selvatica, durante le attività l’accompagnato spegne il proprio cellulare o lo imposta in modalità silenziosa, fatte salve situazioni di emergenza.
– È richiesta l’osservanza di ogni elementare norma di rispetto per l’ambiente in cui si svolge l’escursione, per la fauna selvatica, per la flora, per il silenzio e la bellezza dei luoghi; è richiesto inoltre il totale rispetto del patrimonio storico-archeologico,monumentale e architettonico nonché delle emergenze archeologiche (mobili e immobili) conservate in traccia o allo stato rudere.

Privacy – Il partecipante è informato e consenziente del fatto che la Guida, i collaboratori e gli altri partecipanti potrebbero riprenderlo o fotografarlo in modo anche non incidentale durante lo svolgimento dell’escursione e consente sin d’ora, nell’impossibilità di preavvertire l’uso dell’immagine o del filmato, l’uso dello stesso, in siti, social network, riviste o libri o nella depliantistica promozionale della Guida e collaboratori, liberando tutti – compresi gli altri partecipanti – da ogni futura contestazione in merito.
Se non desidera essere taggato, è consigliato di introdurre il controllo dei tag tra le opzioni della propria pagina FB.
Naturalmente, per quanto riguarda la Guida, si asterrà comunque dal taggarlo a prima e semplice richiesta verbale.
– I dati, di natura comune, qui conferiti saranno trattati nel rispetto del Regolamento Europeo sulla Privacy per finalità organizzative e di fatturazione del servizio. Non saranno in alcun caso trasmessi a terzi, neppure in forma gratuita, senza l’esplicito consenso scritto dell’interessato. Inserendo sul modulo il proprio indirizzo e-mail si esprime il consenso ad essere iscritti nella newsletter “Casa Appennino”. Inserendo il proprio cellulare, nel broadcast Whats App “Casa Appennino” Sarà possibile cancellarsi dalla stessa in qualsiasi momento, usando l’apposito link “cancellami”.– Titolare del trattamento è “Casa Appennino” o “Angelo Bellobono” nella persona del responsabile del trattamento (nome, cognome, mail). Il partecipante può ricevere, a prima e semplice richiesta, la cancellazione o la modifica dei dati trattati, o anche conoscere se sono in corso procedimenti di trattamento e conservazione dei propri dati.

Hiking regulations

Guide Angelo Bellobono is a full member of Lagap (Free Association of Environmental and Hiking Guides Professionals) card No. 731

The Guides are insured for "Civil Liability" for what should happen to you due to their inexperience, recklessness or negligence.

The Guide is not responsible for what happens while traveling by motorized means.

The Guide may not accept participants who are not dressed and equipped as required in the notice.

Participants agree to comply at first and simple request with the Guide's excursion regulations and to have any accompanied minors comply with them.

Dogs, if allowed, must be kept in accordance with the legal requirements for public places and must not be on the registry of biting and behaviorally impaired dogs.

At its sole discretion, the Guide may at any time, in order to protect the safety and well-being of the accompanied (even of a single accompanied), change even substantially the proposed program and itinerary and/or even cancel the excursion by arranging for the group to return.

Participants and the Guide will take photographs or videos.

By participating you acknowledge and agree that they may post your image on social media or make other non-commercial uses of it. You also agree to keep your cell phone on silent mode and not to disturb participants or wildlife.

By participating, you declare that you have taken note of the physical commitment required and that you "do not believe you have any medical conditions that would prevent you from coping comfortably.

The data given here will be treated in accordance with the European Privacy Regulations. Extended copy of the regulations is always available in the Guide's backpack or on website www.casaappennino.it

 

EXTENDED REGULATIONS GUIDE GAE LAGAP

Angelo Bellobono is a full member (card no. 731 )of the "Free Association of Professional Environmental and Hiking Guides"(LAGAP). They practice the profession in accordance with Law 4/2013.

The professional code of conduct to which they adhere is listed, in accordance with the law, in the document area of the website: www.lagap.org. He is duly insured for his activities, with a policy that covers his own Civil Liability; this policy does not cover participants' injuries not attributable to his conduct (i.e., caused by their carelessness or simple bad luck) and car accidents, damage to vehicles or injuries occurring as a result of a car accident that occurred, for example, when approaching and returning to the car by his own means, as well as during any trips made as part of the outing.

The liability policy, moreover, does not cover damages, including those occurring during the excursion, due to wilful behavior of the participants, who are personally responsible for their own behavior and that of the minors accompanied by them, or failure to comply with the Guide's instructions.

Excursion regulations

The participant, in completing and signing the declaration provided before the start of the activities, accepts these regulations, published on the website www.casaappennino.it or disclosed by e-mail, social networks or shown at the start of the activities at the same time as the self-certification and declaration document. A copy of the regulations is always present

in the Guide's backpack for possible reference.

- The participant/applicant, after confirming his or her participation in the activities, agrees to respect the appointment and/or departure time, aware that the maximum delay allowed is 30 minutes. After that time, and at its sole discretion, the Guide may decree the start of the activities (and/or initiate any shifts) without any obligation to wait on the late participant/applicant.

- The Guide reserves the right to deny participation in the initiative to those who present themselves in a visibly unsuitable psychophysical condition (by way of example, as a result of taking drugs or alcohol) and to those who show clothing and equipment that are unsuitable and not in line with what was indicated in the disclosure phase of the initiative itself, without such and equipment unsuitable and not in line with what was indicated when the initiative itself was publicized, without such a decision compromising the activity or posing objections of any kind. Should such circumstances occur after the excursion has taken place (e.g. after lunch at the refuge) they will make any responsibility of the Guide towards the safety of the accompanied person lapse except for the medical aid required by the case.

- If required, the accompanied person shall equi form himself at any time - and have the minors accompanied by him equi form himself - promptly and diligently to the behavior indicated by the Guide regarding - purely by way of example - the pace to be kept, the position with respect to the group, the distance with respect to the other accompanied persons, etc., under penalty of forfeiture of any responsibility of the Guide towards the safety of the accompanied person.

- During the 'activity, the accompanied person is obliged to comply with all the instructions given by the Guide and to follow the established route without straying or leaving the group and without overtaking the Guide, except in cases of specific and justified request by the latter.

He or she also undertakes to behave in accordance with the principles of legality and respect for the principles of civilization and not, under any circumstances, to engage in behavior contrary to the law and civil norms that could endanger his or her own or others' safety. The companion is therefore obliged to observe the utmost prudence at all times so as not to endanger his own and others' safety, to have a disciplined behavior inspired by mutual respect and good manners, to cooperate with the Guide and the other members of the group in order to ensure the success of the activity and to guarantee maximum safety and satisfaction for all.

- At its sole discretion, the Guide may at any time, in order to protect the safety and well-being of those accompanied (even of a single person accompanied), modify even substantially the program (or even call off the return trip) without this in any case giving rise to any dispute on the part of the participants, for example, in the event of bad weather, in the event of injury or serious fatigue or discomfort of one of the participants, and in any other case of actual or presumed danger. Under no circumstances is there any return to the accompanied of the amount paid.

- When publicizing the initiative, the Guide indicates the cases in which the excursion could be postponed, including rain or snow, or generally unsuitable weather conditions: assessments are made on the day before the event,consulting updated forecasts. Once the outing has been confirmed, once the excursion has begun and the participation fee has been paid, no unforeseen weather event, except for explicit cases of immediate or presumed danger assessed as such by the Guide, can permanently interrupt the activity. Should such an eventuality nevertheless occur, the interruption of the activity shall in no case result in the return to the accompanied of the amount paid.

- Due to regulations of territorial authorities or dangers to the accompanied and other hikers, or to the dogs themselves (encounter with guard dogs) dogs are not allowed. The information at the hike always states the circumstance. Dogs, if allowed, must be kept in accordance with the legal requirements for public places and must not be on the registry of biting and behaviorally impaired dogs; summarized, they must be kept on a leash of no more than five feet, and the owner must carry a muzzle and be available to put it on the dog in case of frightening of companions or, in any case, if requested by the Guide.

- In order not to disturb the participants and wildlife, during the activities the companion shall turn off his or her cell phone or set it to silent mode, except in emergency situations.

- It is required the observance of every elementary rule of respect for the environment in which the excursion takes place, for the wildlife, for the flora, for the silence and the beauty of the places; it is also required the total respect of the historical-archaeological,monumental and architectural heritage as well as of the archaeological emergencies (movable and immovable) preserved in trace or ruin state.

 

Privacy- The participant is informed and consents to the fact that the Guide, collaborators and other participants may film or photograph him/her in an even non-incidental manner during the course of the excursion and consents as of now, in the impossibility of forewarning the use of the image or film, the use of the same, in sites, social networks, magazines or books or in the promotional and contributors, freeing everyone-including other participants-from any future challenges in this regard.

If you do not wish to be tagged, you are advised to introduce tag control among the options on your FB page.

Of course, as far as the Guide is concerned, he will still refrain from tagging at first and simple verbal request.

- The data, of a common nature, given here will be processed in accordance with the European Privacy Regulation for organizational and billing purposes of the service. Under no circumstances will they be passed on to third parties, not even free of charge, without the express written consent of the person concerned. By entering your e-mail address on the form you express your consent to be subscribed to the newsletter "Casa Appennino".
